ENTIRETY

The nullity of one of the clauses of this contract will not result in the nullity of the other clauses of the contract or of the contract as a whole, which will retain their full effect and scope. In such a case, the parties must, as far as possible, replace the canceled stipulation with a valid stipulation corresponding to the spirit and purpose hereof.

NON WAIVER

Failure to exercise or delay in exercising any of our rights, remedies, powers or privileges under these Terms of Use and any exchange between us will not constitute and may not be construed as constituting a waiver. Likewise, a partial or single exercise of any right, remedy, power or privilege hereunder will not prevent, thereafter, an exercise thereof or of any other right, remedy, power or privilege on the part of HUME HOUSE.

APPLICABLE RIGHT

This Website, all content present on it and any contract concluded as a result of its use are governed by French law.

To this end, these confidentiality policies are written in French. If they had to be translated into a foreign language, only the version written in French would be law in the event of a dispute.

In the event of a dispute or complaint, you will contact MAISON HUME as a priority. In order to obtain an amicable solution, the Seller and the Customer undertake to cooperate diligently and in good faith.
Pursuant to Ordinance No. 2015-1033 of August 20, 2015, all disputes which may arise in the context of the execution of these general conditions and for which a solution cannot previously be found amicably between the Seller and the Customer must be submitted to a consumer mediator.
In accordance with article L. 612-1 of the Consumer Code, you can call on a mediator free of charge.

The Online Dispute Resolution platform, https://webgate.ec.europa.eu/odr/, set up by the European Commission can be a support solution for the Customer and/or MAISON HUME to resolve the dispute.
However, the voluntary nature of consumer mediation leads to the prohibition of any clause requiring the Customer, in the event of a dispute, to resort to mediation prior to referral to the judge. It also implies the right for the Seller to refuse to enter into mediation, as well as the right, for each of the parties to the dispute, to withdraw at any time from the process or to refuse the solution proposed by the mediator. In the event of refusal of the solution offered by the mediator or in the event of refusal to resort to mediation, the Client may refer the matter to the competent courts in accordance with the French Procedural Code and the French Consumer Code.
